1. Introduction

These Terms and Conditions ("Terms") govern your use of the website at clearpathcoaching.ie and your engagement with the coaching services provided by ClearPath Coaching Ireland ("we", "us", "our"). ClearPath Coaching Ireland is a business operating from 14 Fitzwilliam Square, Dublin 2, D02 TK64, Ireland.

By accessing our website or booking our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

These Terms are governed by Irish law and are intended to comply with the Consumer Rights Act 2022 and all applicable Irish and EU legislation.

2. Our Services

ClearPath Coaching Ireland provides the following services:

All coaching services are provided by ICF-accredited or EMCC-certified coaches. We reserve the right to allocate clients to the most appropriate coach based on their stated needs and goals.

We reserve the right to modify, suspend, or discontinue any service at any time, with reasonable notice to existing clients where possible.

3. Booking and Payment

Bookings

Coaching sessions and programmes may be booked via our website contact form, the booking form on our Coaching page, or by contacting us directly by email or telephone. A booking is confirmed only once we have sent you a written confirmation email.

Pricing

All prices are quoted in Euro (€) and are inclusive of VAT where applicable. Current pricing is displayed on our Services and Coaching pages and is subject to change. Changes to pricing will not affect confirmed bookings already in progress.

Payment Terms

Late payment may result in the suspension of coaching services. Invoices unpaid after 30 days may incur a late payment charge in accordance with the Late Payment in Commercial Transactions Regulations 2012.

4. Cancellation and Rescheduling Policy

Client Cancellations

Programme Cancellations

For multi-session programmes, if you wish to cancel before commencement, a full refund will be issued within 14 days. If you cancel after commencement, you will be charged for sessions completed and a 20% administration fee on the remaining sessions.

ClearPath Cancellations

In the unlikely event that we need to cancel a confirmed session, we will provide as much notice as possible and will offer a rescheduled session at no additional cost. We accept no liability for cancellations caused by circumstances outside our reasonable control.

5. Client Obligations

To get the most from coaching and to ensure the smooth delivery of our services, clients agree to:

We reserve the right to terminate a coaching relationship without refund in cases of abusive, threatening, or inappropriate behaviour toward our coaches or staff.

6. Confidentiality

All coaching sessions are strictly confidential. Our coaches adhere to the ICF and EMCC codes of ethics, which include rigorous confidentiality standards. We will not disclose information shared in coaching sessions to any third party without your explicit written consent, except in the following circumstances:

Clients are also asked to maintain the confidentiality of any information shared by other participants in group coaching settings.

7. Intellectual Property

All content on the ClearPath Coaching Ireland website — including text, images, graphics, articles, tools, and resources — is the intellectual property of ClearPath Coaching Ireland or its content licensors, and is protected by Irish and international copyright law.

Coaching resources, workbooks, and materials provided to clients during programmes are for personal use only and may not be reproduced, distributed, or used commercially without our prior written consent.

You may share links to our publicly available articles, provided proper attribution is given and no content is reproduced in full without permission.

8. Limitation of Liability

Coaching is a voluntary process and clients engage in it at their own discretion. While we work hard to deliver high-quality, evidence-based coaching, we cannot guarantee specific outcomes or results.

To the fullest extent permitted by law, ClearPath Coaching Ireland's liability for any claim arising from our services is limited to the total fees paid by the client for the specific service giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any liability that cannot be excluded under Irish law.

9. Coaching is Not Therapy

Life and professional coaching is a distinct service from counselling, psychotherapy, or medical treatment. Coaching focuses on present circumstances and future goals rather than clinical diagnosis or the treatment of mental health conditions.

If you are experiencing significant mental health difficulties, we may recommend that you seek support from a qualified mental health professional. Our coaches may choose not to accept or continue a coaching engagement if they believe a client requires clinical intervention beyond the scope of coaching.

In engaging with ClearPath, clients acknowledge that coaching is not a substitute for professional medical, legal, financial, or therapeutic advice.

10. Termination

Either party may terminate a coaching engagement at any time. Clients should notify their coach and the ClearPath office in writing. Refund provisions are as outlined in section 4.

We reserve the right to terminate a coaching relationship at our discretion, including but not limited to situations where:

In such cases, we will provide a pro-rata refund for any prepaid sessions not yet delivered, unless termination is due to a client's breach of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Ireland. Any dispute arising from these Terms or the services provided under them shall be subject to the exclusive jurisdiction of the Irish courts, without prejudice to your rights as a consumer under EU law.

If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will notify clients of material changes via email or by posting a notice on our website. Continued use of our services after such notification constitutes your acceptance of the updated Terms. For existing clients mid-programme, material changes to Terms will not take effect until the conclusion of your current programme.
